The Federal Sentencing Guidelines (The Guidelines) state, “an effective compliance program prevents and detects violations of law.” The Guidelines also go on to say that a program should be “reasonably designed, implemented, and enforced so that it generally will be effective in preventing and detecting criminal conduct.”
Many organizations make the mistake of believing that if their compliance program contains the seven basic OIG elements, it must be “effective.” This is not always true.
